14.02.08: In cooperation with our colleagues from Dietrich, Baumgartner & Partners we are initiating a process of recognition and enforcement on the territory of Switzerland of the arbitral award adopted in December 2007 by the ICAC at the Russian Chamber of Commerce and Industry against a defendant registered in Lausanne.

07.02.08: The opening of the Jus Privatum St. Petersburg office is planned for Summer 2008.

18.09.07: The Russian Federal Service on Financial Markets registered the Rules for Trust Management of the Closed Equity Investment Fund for the particular risky (venture) investments administered by a joint stock company, and our client, being a managing company.

10.09.07: The Russian Federal Antimonopoly Service approved the petition of our client, a Dutch Company, for obtaining of a preliminary approval for the transaction on acquiring 100% shares in a charter capital of a Russian Company, owning fixed production assets of a chocolate factory.

Arbitration

As an alternative to the Russian state arbitrazh courts, foreign investors may refer disputes to a private arbitration tribunal, including ad hoc and institutional arbitration tribunals located either within or outside of the Russian Federation. The arbitration proceedings may cover a wide range of issues, with the exception of disputes arising from administrative relations (e.g. tax and customs) and disputes which fall within the exclusive jurisdiction of the Russian arbitrazh courts (e.g. disputes relating to title and other proprietary rights to real estate, located/registered in the Russian Federation, disputes arising from bankruptcy proceedings, or other disputes specifically enumerated in the Arbitrazh Procedural Code and other Russian laws).

Arbitration is the first and primary area of our law practice in Russia. Our attorneys have mastered to perfection all the subtleties and intricacies of procedure in internal arbitration tribunals, international institutional arbitration courts and ad hoc international arbitration tribunals.

The International Commercial Arbitration Court and the Maritime Arbitration Commission of the Chamber of Commerce and Industry of Russia are recognized centers of international commercial arbitration. Our Russian arbitration attorneys have significant experience in handling arbitral proceedings in these courts.

The principal rules of international arbitration in Russia are governed by the Federal Law On International Commercial Arbitration, enacted 7 July 1993; these rules are identical to provisions of the Model UNCITRAL Law.

In addition, the international commercial arbitration provisions of various international treaties to which the Russian Federation is a party and, in particular, the European Convention on International Commercial Arbitration of 1961 and the New York (United Nations) Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 (the New York Convention), also apply in Russia.

We do not limit our arbitration services in Russia to representing our client in the proceedings and receiving a favorable holding.
